Terms of Service

 

Acceptable Material.

Food:

  • Raw, cooked, baked, and otherwise prepared foods

  • Cereal, flour, grains, pasta, and rice

  • Spoiled and expired food

  • Eggs and eggshells

  • Dairy products

  • Meat, fish, bones, seafood shells

  • Nuts, seeds, pits, and shells

  • Coffee grounds and tea leaves

  • Pet food

Food-soiled Paper (Uncoated):

  • Towels and napkins

  • Paper plates

  • Coffee filters and tea bags

  • Paper bags

  • Uncoated food service paper trays and boxes

  • Any other food-soiled paper

Organic Matter:

  • Animal bedding

  • Brew grains

Compostable Products:

  • Must be BPI certified 

Non-Acceptable Materials. 

Client shall only deposit Acceptable Compostable Materials into the containers. Any material deposited into the container that is not Acceptable Compostable Materials cannot be processed by RBR and is considered a contaminant (the "Non-Acceptable Material"). RBR will document presence of Non-Acceptable Material through photograph and/or qualitative record to be shared with the Client. 

Service Location. 

Client shall keep the containers in a location mutually agreed upon by the Parties.

Day of Service.  

RBR shall determine the day(s) of service based on the service route in the area of the Client’s Service Location. The day of service is subject to change throughout the term of the Service Agreement at RBR’s discretion and will be communicated to the Client in writing no less than one week prior to changing.   

Frequency of Service. 

RBR shall collect the containers as needed, based on seasonal fluctuations, the processing needs of Client, and the service route of RBR. The frequency of service may change throughout the term of the Service Agreement at RBR’s discretion. 

Access. 

Client shall maintain the area in which the containers are located to ensure easy and unencumbered access by RBR, including providing weather-dependent clearance. Client agrees to hold harmless and indemnify RBR against all claims, lawsuits, or other liability, including property damage which RBR may face or incur arising out of RBR accessing the containers. 

Containers. 

Client shall only use the containers provided by RBR to deposit the Acceptable Compostable Materials it would like RBR to collect. 

Number of Containers. 

RBR shall provide Client with the number of containers mutually agreed upon by the Parties. Client may request an increase or decrease in the number of containers by notifying RBR by email at least one (1) week in advance of the date that the containers need to be increased or decreased.

Care and Use of Containers. 

RBR is responsible for cleaning the containers. Client is responsible for safeguarding the containers and shall pay RBR the fair market value of any container that is damaged, stolen, or missing, to cover the cost of replacement. This includes containers that are damaged from overfilling. RBR will log and communicate any damages to the containers to the Client. 

Toter Weight Limit. 

The weight limit for 64-gallon containers is 224 lbs. Containers filled beyond this limit are subject to damage and are a working hazard. Client is responsible for keeping the weight of material in the containers below the weight limit. RBR will log and communicate any containers that are found over the weight limit.  RBR reserves the right to terminate the agreement or restrict the Client to 32-gallon containers after repeated offenses.

Spilled Toters.  

RBR is not responsible for cleaning up spilled toters that have occurred outside of service. 

Invoice. 

Client shall pay RBR on a monthly basis for all fees and charges that are outstanding. RBR shall email an invoice to Client on the last business day of the month for the services provided during that month and any other outstanding charges.

Payment Period. 

Client shall pay each invoice in full within Net 15 of the date upon which RBR emails the invoice.

Late Fee

Client shall incur a late payment fee once invoices are outstanding 30 days, calculated at 2% compounded monthly. 

Payment Method. 

Client shall keep a current, valid credit card on file with RBR. All payments made under this Agreement shall be paid in the method selected by Client. 

Term. 

The Service Agreement shall automatically renew at the beginning of each calendar year unless 

Termination.

Either Client or RBR may terminate the Service Agreement for whatever reason by notifying the other Party by e-mail at least 30 days in advance of the effective termination date. Client shall pay all outstanding invoices prior to the effective termination date.
